| Abstract: | This opinion addresses the designation and operation of a framework established under Article 33 (2) of the CRPD at EU level (EU Framework). It aims to clarify the requirements of an EU Framework in light of the monitoring practice and jurisprudence of the CRPD Committee and – with regard to the concept of independence – the Committee interpreting the Paris Principles on the establishment of National Human Rights Institutions (NHRIs). Although concluding observations issued by treaty bodies are not legally binding on parties, they constitute the primary record of findings and recommendations concerning national implementation. They are therefore important interpretative tools for the respective treaties. To ground the advice for the EU Framework in practical terms, the situation in EU Member States regarding national Article 33(2) frameworks is explored in each section. While practices at the national level neither determine normative understanding of Article 33 of the CRPD nor the approach to be taken by the EU, they do offer a valuable evidence base that can inform how to best build the EU Framework. | Abstract: | Without being exhaustive, this opinion discusses selected topics which touch certain Charter rights, identifying the challenges and describing measures that could be taken to mitigate the risk of actions, which are not compliant with the Charter. It does not focus exclusively on risks arising in direct relation to the involvement of EU actors on the ground, but also takes into account that the hotspot approach entails a certain share of responsibility of the EU for the situation in the hotspots overall. Given that the majority of practical experience with the operation of the hotspots was collected during FRA’s field presence in Greece, this opinion is based to a great extent on FRA observations. These are complemented by desk research and findings from FRA missions to Italy. The advice provided therein is conceived in a manner as to be valid for the hotspots in both countries, or indeed for any potential similar operation elsewhere in Europe in the future. The European Commission has proposed revising the Eurodac Regulation to expand the scope so it can also be used to control irregular immigration and movement within the EU. Facial images and personal data would also be stored instead of just fingerprints and basic data such as gender and Member State. | Abstract: | FRA’s opinions highlight general fundamental rights implications to be considered when applying the safe countries of origin concept. They should be read together with the relevant safeguards the Asylum Procedures Directive establishes. These safeguards provide for minimum guarantees that must also fully apply to applicants originating from countries on the proposed EU common list of safe countries of origin. Designation of safe countries of origin can be a legitimate instrument to facilitate the processing of applications from persons whose claims for international protection are likely to be unfounded. Dealing with these claims in an effective manner can have a positive fundamental rights impact by allowing national asylum systems to focus on other persons whose applications are more likely to be well founded, thereby contributing to the reduction of processing times (where applicants remain in a limbo situation) for all applicants for international protection. An EU common list of safe countries of origin would, however, need to be accompanied by sufficient safeguards ensuring, in particular, that it is not to the detriment of fundamental rights of persons in genuine need of international protection originating from the countries in question. | Abstract: | The proposal to establish a European Public Prosecutor’s Office (EPPO), mandated to prosecute crimes against the financial interests of the European Union, raises a number of fundamental rights issues. Following a request from the European Parliament, FRA has published an Opinion that analyses these issues and suggests ways of answering fundamental rights concerns. FRA believes that provided it is a strong and independent institution, the EPPO could serve as a catalyst for harmonised EU legislation elevating the level of protection on matters such as criminal procedures, rights of victims of crime and data protection. However, the EPPO outlined in the proposal poses questions related to several fundamental rights issues, particularly with regard to the complex and at times unclear interaction between the national and EU level. | Abstract: | The FRA delivered an opinion on 31 May on the proposed EU law on the property consequences of registered international partnerships, following a request from European Parliament on 25 April 2012. The proposed regulation (COM(2011) 127 final) does not offer civil partners the same choice as married couples over which national law applies. The FRA's opinion concludes that the proposed law does not provide convincing reasons for denying registered partners a comparable choice as would be offered to married couples.
